Terms of Service

By using this document preparation service, operated by Graham Marsland Pty Ltd (ABN 97 691 274 905) (“we”, “us”, “our”), you agree to these terms.

1. What we do

We provide a document preparation service. When you complete the intake form, an AI model drafts an AFCA complaint document based on the facts you provide and applies published AFCA lead determinations to those facts. We email you the draft within 24 hours of intake. You review it, you decide whether to lodge it, and you lodge it yourself at afca.org.au.

2. What we are NOT

We are not:

We hold no Australian Financial Services Licence, no Australian Credit Licence, and no Australian legal practising certificate. None of these licences are required for the document preparation service we provide.

3. Accuracy of information you provide

You are responsible for the accuracy of the information you provide to us. The draft complaint will reflect what you tell us. If you provide incorrect information the draft may be inaccurate. You are responsible for reviewing the draft before lodging and for correcting any inaccuracies before submitting to AFCA.

4. The first complaint is free

We prepare your first AFCA complaint document at no charge. There is no obligation to purchase anything further.

5. Paid complaints bundle

If you choose to purchase the paid complaints bundle we will prepare up to two additional AFCA complaint documents against other parties involved in your matter (typically your superannuation trustee and a second advice licensee if applicable). The current price for the bundle is $997 AUD. You may also purchase a single additional complaint for $599. Prices include GST where applicable.

Payment is processed by Stripe. Refunds for paid complaints are at our discretion and will be considered in good faith if requested within 14 days of delivery.

6. AI-generated content disclosure

Your complaint document is drafted by an AI model (Anthropic Claude). AI models can produce inaccurate or incomplete output. You must review the draft carefully before lodging it. If you notice an error, reply to the delivery email and we will revise and resend.

7. Ongoing support

While a complaint you have prepared through our service is open at AFCA, you may reply to any email from us at any time with questions. We aim to respond within one business day. This support is part of the service and does not expire while your complaint is open.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with the service is limited to the amount you have paid us (which for the free complaint is zero). Nothing in these terms excludes any consumer guarantees under the Australian Consumer Law that cannot lawfully be excluded. You retain full rights under the Australian Consumer Law.

10. Intellectual property

We own the software, templates, and processes that produce your draft. Once we deliver your draft to you, you own the draft itself and may lodge it, edit it, or share it with AFCA, other representatives, or anyone else.

11. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy.

12. Termination and deletion

You may stop using the service and request deletion of your personal information at any time by emailing graham@grahammarsland.com. We may decline to provide the service or cancel it at our discretion, for example if we believe the information provided is false or the request is outside our scope.

13. Governing law

These terms are governed by the law of Victoria, Australia. Any dispute will be heard in the courts of Victoria.
